Yes, we few white male protestant Constitutional lawyers and judges need not apply, as there is no room on the High court for we WASPs. Current make-up 6 Catholics, 2 Jewish believers.
Because Ms. Kagan is a blank slate - no experience as a judge, and but just one more Court oral argument than your humble blogger, it is imperative that the Senate undertake a comprehensive examination of her constitutional views, while being required to duck no confirmation hearing questions, as well as disclosing all her executive branch writings to the Committee. Indeed, five years ago, the then Junior Senator from Illinois, made an identical demand one day after then President Bush nominated SMU law grad Ms. Miers to the Court. We'll see now whether the President adheres to his own transparency standards.
Now, back to the President's similar commitment to diversity and equal opportunity for Americans of all stripes, as stated in his Nominating Announcement: "[Confirmation of Ms. Kagan will create]... a court that would be more inclusive, more representative, more reflective of us as a people than ever before." Please, stop the mendacity; I know its not raining, you ARE pissing on my shoes. With her ascension, the Supreme court will be peopled soley by Harvard and Yale law grads, with a simple majority being life long residents of either NYC or NJ.
Oh, did I point out that no protestants are now allowed to serve. We are not sure still as to the suitability of gays, closeted or not, but, I presume that you get my point that group identity politics is indefensible. No one's religious beliefs or sexual orientation should matter. It is exclusively the content of Ms. Kagan's character and her commitment to the American Constitution that matters.
Were she to commit to uphold the Constitution as adopted, while leaving the adoption of new civil rights to the will of the people through democratic elections, our great nation will be well served by her confirmation to the court, irrespective of whether she has a crush on Ms. Miers or not. Just saying...
